Terms of Service

Welcome to Yumo. These Terms of Service (“Terms”) govern your use of the Yumo website at yumostudio.app and its subdomains, and all related services, content and features (collectively, the “Service”). By accessing or using the Service in any way, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

1. Using Yumo

1.1 The Service

Yumo is a fan-content studio: it lets you create AI-generated mascots and posters, plus template-based memes, stickers and prediction cards. Free features are provided as-is with a Yumo watermark. AI features consume credits included with paid subscription plans. You must be at least 13 years old (or the minimum digital-consent age in your country) to use Yumo, and at least 18 to make purchases.

1.2 Licence to use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your personal use.

1.3 Service changes and availability

We regularly improve the Service and may update, modify or discontinue any part of it, impose or change limits on features, or restrict access at any time. We will try to give notice of material changes that adversely affect you, but this is not always practical. We strive for high reliability but make no guarantee of availability: the Service is provided “as is” and “as available”, and it depends on third-party providers we do not control.

1.4 Changes to these Terms

We may change these Terms from time to time. If we do, we will update the “Last updated” date and post the updated Terms on this page. Your continued use of the Service after changes take effect means you accept the new Terms. If you do not agree, you must stop using the Service.

2. Accounts

2.1 Creating an account

An account is required for AI generation features. When you create an account you must provide accurate, complete and current information, keep it up to date, not impersonate others, and meet the age requirements above.

2.2 Third-party sign-in

You may be able to sign in using credentials from a third-party service such as Google. By doing so, you permit us to access certain information from that account as allowed by your privacy settings.

2.3 Account security

You are responsible for keeping your credentials secure, for not sharing your account, and for all activity that occurs under your account. Notify us immediately at hello@yumostudio.app if you suspect unauthorised use.

We may suspend or terminate your account if you violate these Terms. If we terminate your account, you lose access to the Service and your data, and we have no obligation to store or return your data.

3. Subscriptions, Purchases and Credits

3.1 Plans

Yumo offers free tools (with a Yumo watermark) and paid subscription plans — Fan, Pro and Creator — billed monthly or yearly. Each plan includes a monthly allowance of AI credits plus the features listed on the pricing page. Features marked “coming soon” on the pricing page are roadmap previews and are not part of the paid service until released.

3.2 Auto-renewal and cancellation

IMPORTANT: unless you cancel, your subscription renews automatically at the end of each billing period (monthly or yearly) at the then-current price. You can cancel at any time from your account settings, via the link in your Paddle receipt email, or by emailing hello@yumostudio.app. To avoid being charged for a renewal, cancel before the end of your current billing period. When you cancel, your plan and its remaining credits stay active until the end of the period you have paid for.

3.3 Credit rules

Payments are processed by Paddle.com, our merchant of record. Paddle handles checkout, billing support, VAT and sales tax; displayed prices include tax where applicable. By making a purchase you agree to Paddle's Buyer Terms and Privacy Policy, and you must provide accurate and complete payment information. We are not responsible for errors made by the payment processor.

3.4 Refunds

If you have not used any credits in the current billing period, you may request a full refund of that period's charge within 14 days by contacting hello@yumostudio.app or through Paddle. Credits that have been spent on generations are non-refundable, except where required by law. Cancelling stops future charges; we do not provide prorated refunds for the remainder of a billing period, except where required by law.

3.5 Pricing changes

We may change plan pricing at any time. If a change affects your active subscription, we will notify you before it takes effect at your next renewal; if you do not agree, you can cancel before the renewal.

4. Generated Content and Ownership

4.1 Ownership of generated content

Yumo makes no claim of ownership over the content you generate. Subject to these Terms and applicable law, you own your generations; content generated on a paid plan may be used for both personal and commercial purposes. We will never publish your creations without your permission, except content you choose to share publicly.

AI output is probabilistic and may be unpredictable. Generations are not guaranteed to match your input, and we make no warranties about their quality, accuracy or nature. You are solely responsible for ensuring your use of generated content complies with applicable law.

5. User Content and Conduct

5.1 Your responsibilities

You are solely responsible for all content you upload or provide through the Service (“User Content”), including photos. You represent and warrant that you own or have all necessary rights to your User Content, that it does not infringe any third-party rights, and that it complies with these Terms and applicable law. Only upload photos of other people with their consent.

You may not upload or transmit User Content that:

You retain ownership of your User Content. You grant us a limited, worldwide, royalty-free licence to host and process it solely to operate and provide the Service, including labelling, classifying and moderating content.

5.4 Privacy and storage

Your creations are private by default and only shared if you choose to publish or share them. Uploaded photos are automatically deleted within 30 days; see our Privacy Policy for full retention details. Deletions are final and irreversible.

We reserve the right, but have no obligation, to monitor and review User Content, remove or refuse to process any content, and suspend or terminate accounts that violate these Terms. To report a violation, email hello@yumostudio.app.

6. Intellectual Property and Copyright

6.1 Yumo's rights

Except for User Content, Yumo and its licensors own all rights, title and interest in the Service, including the software, designs, templates, graphics, interfaces, trademarks and branding. You may not remove, alter or obscure any proprietary notices.

6.2 No affiliation

Yumo is an independent fan project: it is not affiliated with, endorsed by, sponsored by, or connected to FIFA, the FIFA World Cup™, or any national football federation, league, club or player. No official tournament marks, logos, emblems or mascots are used or offered by the Service.

6.3 Copyright complaints

We respect intellectual property rights and will respond to valid copyright infringement notices, and may terminate repeat infringers. If you believe content on Yumo infringes your copyright, send a notice to hello@yumostudio.app containing:

6.4 Counter-notice

If your content was removed due to a copyright complaint and you believe it was removed in error, you may send a counter-notice to the same address with your signature, identification of the removed material, a statement under penalty of perjury that the removal was a mistake or misidentification, and your contact information. We may restore the material 10–14 business days after receiving a valid counter-notice unless the copyright owner files a court action.

7. Disclaimers and Limitation of Liability

7.1 “As is” warranty disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

7.2 AI output disclaimer

We make no representation or warranty regarding the originality, legality, accuracy or fitness of AI-generated content, or whether it infringes third-party rights. You are solely responsible for your use of and reliance on generated content.

7.3 Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, lost profits, loss of data or goodwill, or business interruption. Our total liability for any claim shall not exceed the greater of USD 100 or the amounts you paid us in the 12 months preceding the claim. We are not liable for delays or failures caused by events beyond our reasonable control, including internet outages, cyber attacks, government actions, or unavailability of third-party AI models or services.

7.4 Indemnification

You agree to indemnify and hold harmless Yumo and its operators from any claims, damages, losses and expenses (including reasonable legal fees) arising from your use or misuse of the Service, your User Content or generated content, your violation of these Terms, or your violation of any law or third-party rights.

8. Disputes

If you have a problem, contact us first at hello@yumostudio.app — we will try to resolve it informally. Any dispute arising out of or relating to the Service or these Terms shall be resolved on an individual basis: you and Yumo each waive the right to participate in any class, representative or collective action to the extent permitted by applicable law.

9. General Provisions

9.1 Electronic communications

You consent to receive communications from us electronically (email, notices posted on the Service, in-app notifications), and agree that they satisfy any legal requirement for written communication.

9.2 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without your consent.

9.3 Entire agreement, severability, waiver

These Terms, together with our Privacy Policy, are the entire agreement between you and Yumo regarding the Service. If any provision is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it.

9.4 Relationship of parties

These Terms do not create any agency, partnership, joint venture or employment relationship between you and Yumo, and create no third-party beneficiary rights.

9.5 Termination and survival

You can stop using Yumo and delete your account at any time. Sections that by their nature should survive termination (including ownership, disclaimers and limitation of liability) survive.
